Jawad S Khawaja has filed a petition in the Supreme Court through lawyer Aziz Chaghatai.
In the petition, it was requested that the trial of civilians by military courts should be declared unconstitutional, where are the people handed over for trial in military courts kept? Data should be requested.
The petition also requested that the military courts be ordered to stay the proceedings and prevent them from issuing any final verdict.
It was stated in the petition that the intention of the petitioner was not to support or attack any party or institution.
In the application of Jawad S. Khawaja, the stand was adopted that the applicant has no personal interest in this case and the aim is not to acquit the suspects involved in criminal activities.
The petitioner took the stand that the petitioner does not support any act of the accused, the forum for trying cases against ordinary citizens is the criminal courts.
The petition took the stand that court-martial proceedings can only be conducted against personnel of the armed forces, the purpose of which is to maintain discipline in the forces.
The petitioner contended that while a civilian may be tried in a military court who is a civilian employee serving in the army, the decisions of the military courts will have a direct impact on fundamental rights.
The Ministry of Law, Ministry of Defense, Provincial Governments of Punjab, Khyber Pakhtunkhwa, Sindh and Balochistan have been made parties in the petition filed in the Supreme Court.
