President Asif Ali Zardari has authorized the implementation of emergency measures and governor’s rule in Khyber Pakhtunkhwa pursuant to Articles 232(1) and 234(1) of the Constitution, as announced by the President’s House on Sunday.
According to the proclamation released by the President’s House on Sunday, the emergency has become effective immediately.
The presidential statement indicated that escalating terrorist activities have created substantial risks to citizen safety and property, while incidents targeting government facilities, infrastructure, and law enforcement personnel have intensified.
The statement additionally noted that the provincial administration had not demonstrated adequate resolve or implemented sufficient actions to address terrorism and civil disorder.
The proclamation also referenced a KP governor’s report documenting a collapse of constitutional governance in the province and confirming that the provincial administration could not operate within constitutional parameters.
Given the severity of circumstances, the president determined that immediate constitutional intervention was warranted.
Pursuant to the proclamation issued under Articles 232(1) and 234(1) of the Constitution, the federal government may instruct the KP governor to assume certain or all responsibilities of the provincial administration.
The governor will possess the authority to exercise provincial government functions delegated by the federal government. Additional provincial bodies and organizations, with the exception of the provincial assembly, may similarly have certain or all of their functions performed by the governor under federal instruction.
The proclamation additionally specifies that the KP Assembly’s functions will be carried out by Parliament or pursuant to its direction.
The chief minister, provincial cabinet members, consultants, special assistants, and advocate general will immediately relinquish their positions, per the announcement.
The presidential proclamation has taken effect immediately.
