
Five esteemed judges of the Islamabad High Court (IHC) have lodged a meticulous intra-court appeal through the seasoned and highly respected senior lawyer, Munir A. Malik. This appeal boldly challenges the Supreme Court’s ruling that endorsed their transfers in the contentious judges’ transfer case.
Previously, a formidable five-member constitutional bench of the Supreme Court issued a decision favoring judicial transfers within the IHC and directed that the intricate matter of seniority be presented to the President of Pakistan for resolution.
In their detailed intra-court appeal, the IHC judges have passionately urged the court to overturn the Supreme Court’s verdict of June 19 and to place a stay on its execution until their appeal has been thoroughly deliberated and resolved.
As a reminder, on June 19, 2025, the Supreme Court dismissed the petitions filed by five IHC judges opposing the transfer of three of their fellow judges, determining the transfers to be constitutional and in accordance with the law.
The apex court delivered a 3-2 majority judgment, clearly stating that the relocation of judges did not violate the constitution. Justices Muhammad Ali Mazhar, Shahid Bilal Hassan, and Salahuddin Panhwar declared that the President possessed the authority to transfer high court judges from one jurisdiction to another.
